Trash or Treasure: How the WTO Can Help Facilitate a Circular Economy for Critical Minerals

WITA hosted a panel at the WTO Public Forum in Geneva, Switzerland discussing the impending shortage of critical minerals and how international organizations like the WTO can promote recycling and reusing through trade policy reforms and enhanced reverse supply chains.

Demand for critical minerals needed to support a clean energy transition and many other applications will outstrip supply in the coming decade. This will necessitate a pivot to recycling and reusing those critical minerals rather than relying solely on going to the mine for virgin extraction. Traditionally, trade policies focus on first-use products, with rules of origin, and domestic policies on re-use, recycling and re-manufacture actually discouraging trade in previously used products.

Panelists explored how the WTO can help to facilitate reverse supply chains that enhance trade in secondary, used, and reusable goods and materials. Discussants also looked at how the WTO, World Customs Organization, and Basel Agreement can work together on customs nomenclature that supports trade in reusable and recyclable materials rather than simply classifying them as “waste.”

Christine Bannan is U.S. Public Policy Manager at Proton, the technology company offering a suite of privacy tools and most known for Proton Mail, the world’s largest end-to-end encrypted email service. She advocates for policies that protect user privacy and security and create competitive digital markets. Previously she worked as Policy Counsel at New America’s Open Technology Institute and Consumer Protection Counsel at EPIC (the Electronic Privacy Information Center) where she advocated for comprehensive privacy legislation. She received her J.D. from Notre Dame Law School and B.A. from College of the Holy Cross.

Dr. Josh Meltzer is a Senior Fellow at the Brookings Institution in Washington D.C., where his research focuses on how data flows enable digital trade and  emerging technologies such as AI, and the trade law and regulatory implications of cross-border data flows, including for privacy and cybersecurity. At Brookings, Meltzer leads the Digital Economy and Trade Project and co-leads the Forum on Cooperation in AI. Meltzer has testified before the U.S. Congress, the U.S. International Trade Commission and the European Parliament. He has been an expert witness in the Schremss II litigation in the EU and a consultant to the World Bank on trade and privacy matters. He is a member of Australia’s National Data Advisory Council and National AI Action Programs Committee. Meltzer teaches digital trade law at Melbourne University and at the University of Toronto, where he is an adjunct professor. Meltzer also teaches ecommerce and digital trade at the UK Foreign, Commonwealth and Development Office diplomatic academy. Additional academic appointments have included as an adjunct professor at Johns Hopkins School for Advanced International Studies where he taught international trade and at McGill University.  Before joining Brookings, Meltzer was posted as a diplomat at the Australian Embassy in Washington D.C. and prior to that he was an international trade negotiator in Australia’s Department of Foreign Affairs and Trade. Meltzer regularly appears in print and news media, including the Economist, the New York Times, the Washington Post, CNN, Bloomberg, MSNBC, CBS, Fox, the Asahi Shimbun and China Daily. Meltzer holds an S.J.D. and LL.M. from the University of Michigan Law School in Ann Arbor and law and commerce degrees from Monash University in Melbourne, Australia. 

Melinda St. Louis is the Director of Public Citizen’s Global Trade Watch. Since working alongside labor unions and farmer organizations in Nicaragua fighting for fair trade policies more than two decades ago, St. Louis has developed deep expertise in trade and globalization issues and fought for progressive alternatives to corporate globalization that benefit people and the planet. She provides expert analysis of technical trade agreement provisions and implications for domestic policymaking to Congress and high-level government officials, the press, and civil society partners in the U.S. and around the globe and has helped lead successful campaigns to stop the corporate agenda of the Trans-Pacific Partnership, advance official discussions at the World Trade Organization about financial regulation, and support governments exiting from harmful investment treaties. She is a committed coalition builder, nurturing numerous global South-North coalitions, as well as broad and deep coalitions across the U.S., working cross-culturally to build trust, plan together, and implement coordinated strategic actions to challenge corporate power.

She is available to discuss the impact of trade and investment agreements on wide-ranging domestic issues, including medicine pricing, financial deregulation, human rights, workers’ rights, environmental protection, and food safety. Prior to her current position at Public Citizen, she designed and led the organization’s Medicare for All campaign and directed international campaigning at Global Trade Watch. Before joining Public Citizen, she was policy director at the Jubilee USA Network, leading faith-based efforts to cancel debt and reform international financial institutions, and executive director of Witness for Peace, where she led efforts to reform U.S. economic, military and immigration policy toward Latin America. She earned an M.P.P. in international policy and development from Georgetown University and a B.A. in international politics and Spanish at Penn State University, where she graduated at the top of her class.

She has appeared or been quoted in dozens of U.S. and international television, radio, and print media outlets.

Sean Heather is Senior Vice President for International Regulatory Affairs and Antitrust at the U.S. Chamber of Commerce. He leads the Chamber’s Center for Global Regulatory Cooperation (GRC), which seeks to align trade, regulatory, and competition policy in support of open and competitive markets, and oversees the organization’s antitrust policy on behalf of its members.

On the international level, Heather directs policy related to data governance, cross-border data flows, artificial intelligence, cybersecurity, and other emerging regulatory frameworks related to the digital transformation of the economy. His efforts focus on advancing sound regulatory practices as the foundation of better regulation and cooperation across jurisdictions. In addition, he is responsible for policy related to foreign direct investment and investment screening.

Heather has made significant contributions to update trade disciplines that address issues ranging from digital trade and regulatory cooperation to competition policy and state-owned enterprises.

Heather has held a variety of positions during his long career at the Chamber. He served in the Congressional and Public Affairs Division and was head of the Chamber’s regional office in Chicago.

Before joining the Chamber, Heather worked for the Illinois comptroller and with several political campaigns across the state. He holds an undergraduate degree and an M.B.A. from the University of Illinois.

On Monday, February 13th, 2023, and Tuesday, February 14th, 2023, WITA hosted its fifth annual Washington International Trade Conference (WITC). This conference brought together leaders in international trade from across the U.S. and around the world to explore the trade landscape and look toward the future of trade. 

The event began with remarks from Kenneth I. Levinson, Executive Director of WITA, as he introduced the first two panelists: Angela Ellard, Deputy Director-General and World Trade Organization and Ambassador Rufus Yerxa, Senior Advisor, McLarty Associates; former WTO Deputy Director General; and former Deputy USTR.

The fourth panel, “Trade, Supply Chains and Industrial Policy”, included speakers Simon J. The start of the second day began with the panel providing an “Update From Congress” with U.S. Senator Mike Crapo (R-ID), Ranking Republican, Senate Finance Committee and Moderator Steve Lamar, President & CEO, American Apparel and Footwear Association, and President of the WITA Board of Directors. 



The second panel featured an “Update on the Administration’s Trade Agenda”, Marisa Lago, U.S. Under Secretary of Commerce for International Trade opened the panel with remarks followed by questions from Moderator Wendy Cutler, Vice President, Asia Society Policy Institute and Managing Director of the Washington, D.C. Office; and former Acting Deputy United States Trade Representative. 


The closing session of the 2023 Washington International Trade Conference was the “Trade Around the World Ambassadors Roundtable” featuring Hon. Ashok Kumar Mirpuri, Ambassador of Singapore to the United States, Hon. Speaker Biographies:

Angela Ellard

Angela Ellard has served as the World Trade Organization’s Deputy Director-General since June 2021. Prior to her appointment, Ms Ellard had a distinguished career serving in the US Congress as Majority and Minority Chief Trade Counsel for over 26 years. She is internationally recognized as an expert on trade and international economic policy, resolving trade and investment barriers, negotiating trade agreements, and supporting multilateral solutions as part of an effective trade and development policy. 

Ms Ellard has negotiated and delivered significant bipartisan trade policy outcomes and legislation with Members of U.S. Congress and senior Biden, Trump, Obama, Bush, and Clinton Administration officials. Ms Ellard was also a lawyer in the private sector, specializing in trade litigation and strategy, trade policy, and legislative issues.

Ms Ellard obtained her Juris Doctor, cum laude, from Tulane University School of Law and her Master of Arts in Public Policy also from Tulane. She received her Bachelor of Arts from Newcomb College of Tulane University, summa cum laude. Ms Ellard is a frequent lecturer at law – graduate, and undergraduate classes. She has received numerous awards recognizing her accomplishments in trade law and policy.

Sarah V. Stewart is the Executive Director of Silverado Policy Accelerator. Ms. Stewart has nearly two decades of experience as an international trade lawyer, trade policy expert, and trade negotiator.

Immediately prior to joining Silverado, Ms. Stewart led the public policy efforts at Amazon on U.S. trade policy and export controls matters. From 2013 to 2018, Ms. Stewart worked for the Office of the United States Trade Representative, with her most recent position being the Deputy Assistant USTR for Environment and Natural Resources. During her time at USTR, Ms. Stewart was the lead environment chapter negotiator for the US-Mexico-Canada Agreement and the Transatlantic Trade and Investment Partnership (TTIP) negotiations with the European Union.

Prior to joining USTR, Ms. Stewart served in different legal and policy roles at The Humane Society of the United States and Humane Society International, including spearheading a first ever international legal group. Ms. Stewart began her career at the Law Offices of Stewart and Stewart, where she worked on behalf of U.S. manufacturing companies and workers. Ms. Stewart serves as a policy advisor for the Center for Climate and Trade, is a fellow at the National Security Institute, and is on the advisory board of American University’s Washington College of Law Program on Environmental and Energy Law.

 

Jennifer Prescott

Jennifer Prescott joined Amazon in 2020 and serves as Director for International Trade and Tax Policy for Amazon Web Services (AWS), as well as Director of Latin America Public Policy for AWS. Prior to joining Amazon, Jennifer served as Assistant United States Trade Representative (USTR) for Environment and Natural Resources, and while at USTR, she led negotiations on a variety of bilateral, regional and multilateral trade agreements, including the US-Mexico-Canada Agreement (USMCA) and the TransPacific Partnership (TPP) Agreement. Jennifer also chaired a number of interagency committees charged with overseeing implementation of U.S. trade agreements, as well as developing trade policies to promote clean and renewable energy technologies. When first joining USTR in 2001, Jennifer served as Director for Transatlantic Trade Issues in USTR’s Office of Europe and the Mediterranean.

Prior to joining USTR, Jennifer held several positions at the U.S. Department of Commerce, International Trade Administration (ITA), including work to coordinate ITA’s participation in multilateral standards-setting bodies, as well as multilateral rules governing chemicals and biotechnology trade. Jennifer began her career in Washington in the U.S. Senate.

Jennifer holds a Master’s degree from the Maxwell School at Syracuse University, and a Bachelor’s degree from Miami University in Oxford, Ohio.

On Wednesday, March 23, WITA partnered with the Institute for International Economic Policy for a hybrid event. Former Congressman James Bacchus discussed that the World Trade Organization is undergoing an existential crisis. He highlighted that this global organization can survive and will continue to succeed but only if the trade links among WTO members are revitalized and reimagined. He explained how to bring the WTO into the twenty-first century, exploring the ways it can be utilized to combat future pandemics and climate change and advance sustainable development, all while continuing to foster free trade.

Alyssa Ayres is the Dean of the Elliott School of International Affairs at George Washington University. Her work focuses primarily on India’s role in the world and on U.S. relations with South Asia in the larger Indo-Pacific. Before joining the Elliott School, she was a Senior Fellow at the Council on Foreign Relations, and Deputy Assistant Secretary of State for South Asia under the Obama administration. She holds a Ph.D. in South Asian Languages and Civilizations from the University of Chicago.

James Bacchus is a Distinguished University Professor of Global Affairs and Director of the Center for Global Economic and Environmental Opportunity of the University of Central Florida. He was a founding judge and was twice Chairman – the chief judge – of the Appellate Body of the World Trade Organization. He is a former Member of the Congress of the United States, from Florida, and a former US trade negotiator.

He serves on the United States Leadership Council of the United Nations Sustainable Development Solutions Network, served on the High-Level Advisory Panel to the Conference of Parties of the United Nations Framework Convention on Climate Change, chaired the global council on governance for sustainability of the World Economic Forum, and chaired the Commission on Trade and Investment Policy of the International Chamber of Commerce.

He is adjunct scholar for the Cato Institute in Washington, DC; global fellow of the Centre for International Governance Innovation in Canada; distinguished fellow of the European Institute for International Law and International Relations, and Pao Yue-Kong University Chair Professor of international law at Zhejiang University in Hangzhou, China.

Professor Bacchus is the author of Trade and Freedom (London: Cameron May, 2004); The Willing World: Shaping and Sharing a Sustainable Global Prosperity (London: Cambridge University Press, 2018), named one of the “Best Books of the Year” by the Financial Times of London; and, with co-author Inu Manak, The Development Dimension: Special and Differential Treatment in Trade (London: Routledge Press, 2021). His new book, Trade Links: New Rules for a New World, will be published by Cambridge University Press in early 2022.

Robert B. Koopman serves as the Chief Economist and Director of the Economic Research and Statistics Division at the World Trade Organization. In this post Bob provides the Secretariat and Member Countries with analysis and information that promotes a deeper understanding of trade and trade policy’s role in economic growth and development.

Prior to this post he served as the Director of Operations and Chief Operating Officer for the United States International Trade Commission. Bob oversaw the Commission’s trade policy research and negotiation assistance to the President, the U.S. Trade Representative, and Congress; antidumping, countervailing duty, and safeguard; investigations; intellectual property investigations; maintenance and analysis of the Harmonized Tariff System, as well as the agency’s strategic planning and performance measurement initiatives. He also previously served as the Chief Economist and Director of the USITC Office of Economics, and numerous leadership and research positions at the Economic Research Service of USDA.

Bob previously taught international trade, applied international trade, advanced international trade, and trade and economic development in the Economics Department at Georgetown University, in Washington DC. Bob‘s research interests include measuring the economic effects of trade and trade policy changes, measuring global value chains, and the application and validation of large scale economic simulation models. Bob also currently serves as an ex officio member of the World Trade Review Editorial Board, and serves as an editor for the Springer Series Advances in Applied General Equilibrium Modeling, with James Giesecke and Peter Dixon.

Professor Michael Moore is Director of the Masters of Arts in International Economic Policy program and has been a faculty member at the Elliott School since receiving his doctorate in 1988. He received his B.A. in liberal arts from the University of Texas at Austin and his M.S. and Ph.D. in economics from the University of Wisconsin-Madison. Professor Moore teaches undergraduate and graduate courses in international trade theory and policy as well as international macroeconomics. He also has taught international economics to US diplomats at the Foreign Service Institute and students at the Fondation Nationale des Sciences Politiques (Sciences-Po) in Paris. He has published in numerous academic journals including the Journal of International Economics, International Trade Journal, Canadian Journal of Economics, Review of International Economics, European Journal of Political Economy, and Weltwirtschaftliches Archiv, and has been a contributor to five books. His commentary has appeared in numerous media outlets, including The Washington Post, The Financial Times, CNN, CBC, NPR, and NBC.

Professor Moore has served as Director of the Institute for International Economic Policy, Director of the International Trade and Investment Policy Program, and Associate Dean at the Elliott School.

Professor Moore served as Senior Economist for international trade on the President’s Council of Economic Advisors from 2002 to 2003.
